乾貨｜法律英語詞義辨析：行為

前言

在上一期的推送中，我們一起辨析了act這一詞彙的“法律”這一詞義；除了“法律”，act還有“行為”的含義。我們每天都會做很多事情：飲食、睡眠、工作等等。這些事都可以被稱為行為，即受思想支配而表現出來的外表活動。日常生活中，人們會做出很多種行為 。而與“行為”相關的詞彙還有哪些呢，它們之間又有什麼異同呢，我們今天就一起來辨析一下。

Act / Action / Deed / Performance

行為

act

多指按自己的意願已經完成的行為。

（Something done or performed，

especially， voluntarily。）

例如：

持續行為（continuing act）

雙邊行為（bilateral act）

action

除了指已完成的行為以外，

還指正在進行的行為或者完成行為的程式。

（The process of doing something；

conduct or behavior。）

例如：

每日行動

（action de die in diem）

模擬行動宣言

（action en declaration de simulation）

deed

常指需要極大勇氣、情操、智慧、

力量或技能所取得的成就行為。

（Something that is done or carried out；

an act or action）

例如：

Their deed will lie on in song。

His heroic deeds were celebrated

in every corner of India。

The perpetrators of this evil deed

must be brought to justice。

performance

所指的行為常與行為人作為時的方式相關。

（The act or process of performing a task，

an action。）

例如：

履約保函

（performance bond）

She has shown enthusiasm

in the performance of her duties。

人的行為有很多種，

攻擊別人就是其中一種。

Aggression / Assault

Attack / Offensive

攻擊

aggression

多指無故違反聯合國憲章規定的戰爭行為，

如侵略別國的行為。

（The act of attacking a country， especially，

in the absence of direct provocation。）

例如：

The dictator resorted an armed aggression。

assault

指猛烈攻擊，尤其指近距離的身體接觸和暴力，

常針對某個人或少數人，且常帶有嫉妒、

怨恨等個人情感。

（The act of putting another person

in reasonable fear。）

例如：

He pleaded guilty to assaulting a police officer。

attack

（用武力）進攻；攻擊；襲擊

（Act against aggressively in

an attempt to injure or kill。）

例如：

A doctor was attacked by two youths。

offensive

有時與attack互換使用，指進攻、襲擊；

有時則指大規模軍事進攻行動。

（Making attack； aggressive。）

例如：

攻防同盟

（offensive and defensive league）

進攻鎖定

（offensive lockout）
